Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of RoomRecast and any related websites, applications, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility; Accounts

  • You must be at least 13 years old to use the Services.
  • You are responsible for all activity under your account and for maintaining the security of your login credentials.

2. Credits; Billing

  • Certain features require paid credits. Credits, bundles, and subscription options (if any) are shown at checkout and on pricing pages. Prices may change prospectively.
  • Unless required by law, purchased credits are non‑refundable and have no cash value. Promotional credits may expire or be revoked if misused.
  • You authorize us to charge your selected payment method.

3. Acceptable Use

  • Do not upload, generate, or share content that is illegal, infringing, hateful, harassing, exploitative, or otherwise violates applicable law or these Terms.
  • Do not attempt to reverse engineer, interfere with, or disrupt the Services or their security.
  • Respect intellectual property and privacy rights. Only upload content you own or have permission to use.

4. Your Content

  • “Your Content” includes images, text, prompts, and other materials you submit. You retain ownership of Your Content.
  • You grant RoomRecast a worldwide, non‑exclusive license to host, process, and display Your Content solely to provide the Services and associated features (e.g., previews, downloads, history).
  • You represent and warrant that you have all rights necessary to grant the above license and that Your Content does not infringe or violate any third‑party rights or laws.

5. Generated Output

  • Images, videos, and other media generated by the Services (“Output”) are produced using AI models and third‑party infrastructure. Output may be imperfect or contain artifacts; validate fitness for your use.
  • Subject to these Terms and applicable law, you may use Output for personal or commercial purposes. You are responsible for ensuring your use of Output (and any depicted elements) complies with all laws, platform policies, and third‑party rights.
  • We may automatically store certain Output and related URLs to help you re‑use or re‑download results.

6. Third‑Party Services

The Services may rely on or link to third‑party services, models, hosting, or payment providers. We are not responsible for third‑party content, terms, or policies.

7. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share information about you. The Privacy Policy is incorporated into these Terms by reference. By using the Services, you consent to the processing of your information as described in the Privacy Policy.

8. Availability; Changes

  • We may update, suspend, or discontinue all or part of the Services at any time. We will attempt to provide reasonable notice where practical.
  • We may modify these Terms prospectively by posting an updated version with a new “Last updated” date. Continued use after changes means you accept the revised Terms.

9. Disclaimers

THE SERVICES AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑ INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR‑FREE, OR THAT OUTPUT WILL MEET YOUR REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ROOMRECAST OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID (IF ANY) FOR THE SERVICES IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You will indemnify and hold harmless RoomRecast and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from or related to Your Content, your use of the Services, or your violation of these Terms or any applicable law or third‑party right.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including for any violation of these Terms. On termination, the sections that by their nature should survive will survive (including ownership, disclaimers, limitations of liability, and indemnities).

13. Governing Law; Dispute Resolution

These Terms are governed by the laws applicable where RoomRecast is organized, without regard to conflict of laws principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by mandatory law.
